for letting people ride in your car?

yeah, yeah I know sounds odd...but this is for charity work..& I don't want to turn around and have some one say they got hurt getting in/out of the car & sue me...

You can make your own up.  These waivers are as good as the paper they are printed on.  Regaurdless of signed waiver if someone can prove neglagents on your part you can be sued.

what would just a basic waiver cover? be written up?
I know if I was to do something stupid & hurt some one..I could be sued..but I'm wanting to "protect" myself from them hurting thier back say getting in the car... ect...

Ok what exactly are you doing.  Taking them for a terror trip?  Drag Race?

I would spell out the dangers of doing what ever you plan and have them INITIAL and sign and date along with a WITNESS for YOU.

You have to spell everything out as otherwise it would be to vauge....

Yes, also if they really want to they could still sue but if they have signed a wavier that states all the possible dangers along with a statement to the fact they have FULLY read and understand.

ok, here's what I've got going on...

Kinda like a make a wish type thing.. I have a few kids that want to ride in the car w/ permission of the parents.. this would be a drive around the block down the street & have some pictures made w/ the car.. but just need something to release me from someone looking to make a buck. not going out on a ride to scare the hell outta anyone,  just a sunday - granny drive...

Wait a minute...you're taking kids in your charger and you're worried about them sueing you ? I'd sue them for the least . :D
I'd make one stating that every wowwiepop left behind will cost them a marsbar, sticky fingers need to remain outside the vehicle at all times ! And sound available is V8 and V8 only, and a woohoo or two...

Just tell the parents that you won't charge anything but fuel used to cruise the block with a munchkin in the back, after you explain the mileage of it and the parents come around again, the kids will just follow you around on their bikes, that's fun too on dirtpaths ! Dang I'm rotten....

the parents have already made a donation to a local group for christmas wish.. I was told that I shouldget a waiver -so no one can sue -if a parent was to ride or a kid.. so no one could say they hurt thier arm getting in..or leg getting out..ect..  I was also told it would be best to have it in writing so if someone did get hurt they couldn't say- (after being told) -not responsible for accidents..ect.. so it don't come back as a he said- she said situation

Sounds good to me, I say put that on paper in clear unformal writing and you're set.
Tons of pics of hazardous areas on the charger like doorjambs are no luxury either, besides...we love pics and it's an excuse for you to start posting some !  :icon_smile_big:

IMO You are better off paying a nominal fee to your insurance company to add a little more coverage to your policy for the day or two these people will be in your car. I would still have them sign it...just shows good faith and lets them know that your not someone to be taken advantage of. Also, I might consider making them provide a doctors release if any of them are fragile, semi ambulatory or terminally ill.

Pay an attorney $100 to make up a waiver. It will be worth it in the long run if someting should happen.

Parents can't waive the rights of their kids and the kid has the right to sue until the age of majority, usually 18, plus the statute of limitations, in California a year for personal injury (that might have changed to two years -- this is not my area of practice).  You can bs some folks that they can't sue you by having them sign a form, but the writing won't really apply to them and it certainly won't apply to the kids -- plus it will be a turn off for everyone.  There may be some legal tricks to limit your liability, like claiming that the people assumed the risk as an affirmative defense but that likely won't fly.  As far as I know, car insurance has a medical payment of 5k or so regardless of fault and it also provides coverage for passengers.  I imagine that your insurance policy would cover this -- read it and see if there is an exclusion for commercial or charitable events.  If you still want a waiver, snag one from the last car show you went to and just adapt it.  If it were me I would no more worry about this than worrying whether the sun comes up tomorrow.  It is just too remote to make me lose sleep.  Kim

I would also make a little announcement to all those involved or make up a piece of paper that states

"you are going to be riding in a car that is 30+ years old and because of available technology at the time of manufacter this car does NOT have.
1. Airbags
2. crumple zones
3. side impact airbags
4. AWD
6. Traction control
7. Ride stabilization computers
8. Fuel Injection
9. Climate zone sensors
10. 200+ cup holders
11. Or any other of the 1000 safety features that modern days cars have

As a matter of fact you are lucky I have seat belts being over 30 years old who knows how they will stand up under impact. So ride with me at your own risk. Like your mommy and daddy did when they were your age and rode in cars without any of the stuff they have now. When we used to stand up in the back seat while driving down the road at 70MPH.

So RIDE AT YOUR OWN RISK!!!!
