Well, just tell your side of the story to the court, I guess.  Where do you live?  Magistrate Court to me sounds like you are not in the U.S. but .......

I think I would tell the court he owes YOU for repairs and storage !!  Sounds like you can count on the father lying about the situation to the court.  Just tell it like it happened.  No guarantees but, hopefully, the court will be able to discern the truth!

Sounds like a case of the people who move next to a race track and then complain its too loud.

That happened to a local motor cross track.  Also happened to a lot of farmers, although, I haven't heard many of those stories since '08.

BUT, in this case, do we know the illegal repair shop was there before the old ladies?

I live in georgia, a friend of mine hooked me up with someone that works at the court house in my county to tell him my side of the story. The guy taking me to court lives in the county beside of me, I am the last house in my county but he doesn't know that. The guy at the court house said he can't sue me in a different county so they can't try a case out of it's venue. Also he asked where the owner of the RV is and I told him he had shot himself and had passed away. He said if there was no will showing the RV was left to him then he can't claim it as his so he can't collect nothing on something he doesn't own.

He also said that I can file a counter-claim for my labor and parts that is owed to me for working on it. I doubt he want's to pay for anything, he is just looking for a dollar.

He asked where the RV went and I told him if I had to produce it I could, but only if he want's to pay the bill on it. And then he will have to pay to have someone to go get it.

This guy thinks the RV is long gone and he is gonna get some money for sure but I bet he will be back peddling when I say if he wants that junk pile back I can produce it.

Since he filed a claim out of his venue and they have to trow it out because of that he will have to come to my county and file another claim all over again. I think it cost's about 80 bucks to file a claim so he is already out 80 and he will be out another 80 once he has to file again.

Sadly all of this is over an RV that maybe worth 500 to 800 bucks

An update on this:

The ladies lost their appeal!

  • Plaintiffs' request for an injunction to remove Defendant's Pole Building is DENIED.

  • Plaintiffs' request that I order the Defendant to remove the ornamental signs on his property is DENIED.
  • The Plaintiffs have failed to establish that the Defendant has created a nuisance per se, and no relief under that theory is available to the Plaintiffs.

Had to go for a pre-trial today, the judge had us sit down with a mediator to try and work out a solution to the issue without going in front of the judge. He told the mediator the motorhome was only at my residence for 8 months but I had a receipt for the carb kit and fuel pump on it from may 2014. It was on my property for 22 months total. From august 2014 to march 2016 without any communication from the owner. It was abandoned for 18 months here without any communication from or with the owner. The mediator told him that was a long time and asked why didn't someone pick it up from here. That's what I didn't understand, if it meant so much to them why did they dump it off in my yard and leave it and refuse to come and get it. He had no title to the motor home and I had the tag ran and it came back in his son's name only. The mediator told him he couldn't claim something that he didn't actually own unless there were legal paper's showing that it would go to him if something happened to the owner which he didn't have.

The guy could see he didn't have a case and got irritated pretty quickly once thing's didn't seem to be going his way. He thought it had a 440 in it which would have made it somewhat worth something but it was the smaller 413 engine which is not very desirable so that was another strike against the worth of the motorhome. I didn't really see a solution and since my brother had it sold for $1000 and my repair bill was $886 I offered him $114 to settle and be done with this crap. He wasn't happy with my offer then he just said screw it i'm done here and tossed papers around on the desk and signed off that he was done with it. He said he didn't want my $114 bucks and was done. I signed that it was resolved and hit the door and never looked back.

I really don't understand how someone could leave a vehicle on someone else's property without coming by and checking on the vehicle or calling or nothing. It was only here for the free parking and that's what I told the mediator. They didn't have anywhere to park it but it wasn't mine and wasn't my responsibility to keep it here. The mediator told him that if it was here for that amount of time on my property that I could have it removed since after that long it would be considered an abandoned vehicle.

I honestly just wanted it gone and hopefully this is the end of the motorhome ordeal....

Ryan.C

man what a headache.

At least you got that ordeal out of the way. No good deed goes unpunished eh?

I used to know an old timer who bought the  hell out of the 413's they are fairly rare and he would bore them to 426....

Yeah, glad to get it over with. Honestly wish the guy would have just came and got it but he had no intention of moving from my back yard. There are people out there that seem to like the 413 engines but very few around here. The 440 seems to be the go to engine for most people that are into mopar's around these parts. I have a good 413 RV block in my storage building I would like to toss out for scrap. I hate to do that because like you say someone may actually want it.

That's great news!, sad to see these old bitches have no life or soul, I could care less if the guy was running an illegal repair shop, he's in a dam wheelchair trying to be productive rather than a vegetable, even if he was collecting full disability while running HIS BUSINESS! it still wouldn't bother me one bit, the man is trying his damnedest to remain a functioning human being

I have a 413 out of an 65 Imperial. I plan you use the crank and rods to stuff into a worn out 383 I have to make a 431/434 stroker engine. They can be useful  :Twocents:

Yeah, I kept the crank and rods out of the engine it's the block that really is of no use to me. I have a couple of good 440 blocks to work with if I need to build one up....
