I can recall when the Carrie Underwood song "Next Time He Cheats" first came out, this was a topic addressed on a local call an attorney night.  If the car was a gift, belong to him prior, was titled in his name, or in any way not hers, she is liable for damage. If it was purchased jointly or she is on the title or it was her car previously, nothing can be done about it other than file a restraining order.
