Hey gang..
Simple question: In Texas, if the buyer of a new home being built by seller (new home builder) has done everything they are supposed to do on time, i.e, earnest payment, deposit, attended all design and pre-construction meetings, can seller pull the carpet and not sell to buyer per contract?

As a contracter in CA, a contract is a contract.  If I put in a bid for a job then that's it.  We have agreed that I will perform said work for a given price.  If I make a mistake and bid a 135,000 dollar job for 35,000 and sign the paper, then I am still obligated to perform the job for 35,000.  There may have been a clause in one of the contracts that you signed that may allow the contracter to back out of the sale, but I would doubt that it would actually be legal.  In todays market, I can't imagine why a builder would try to back out of a sure sale unless they had made a mistake like I just outlined.  Please keep us informed, this sounds pretty interesting to me, and frustrating for you.  Good luck.

Well, everything turned out to be ok in the end, had the meeting last night with the VP of Operations. They wanted us to sign an contract addendum. There were certain things I didn't like and requested them to be removed. In the end, there were provisions in there to cover their butt and provisions in there to cover ours....... So, all's well as of today and we can all press forward...... One month to go !!!
