I have a question, same one posed on another forum...., Is it wrong to self-promote our house to sell to other agents? I mean, our agent hasn't, to the best of my knowledge, had a "realtor's day" at our house and only one "open-house" in 5 months.. Now that I've found the perfect house to buy, in option period now, the time is really set forth in selling ours.....

I don't think your realtor will have any problem having you sell your house so they can collect the commission. If you signed a contract with your current, they collect their commission. Even if you sell it....

Well, if the exposure doesn't increase soon, i.e, flyer boxes and another open house, I can request a termination of representation prior to the end date.... I do know that, but it has to go through the broker...

If you are not satisfied with your realtor, you should immediately fire them and find another one.  Why pay for a service when you are not getting the service.

But make sure you are ready to do so. Don't drag your feet. I would suggest the agent that the house your buying might have a interest in getting your house sold.

It's going to come down to what the contract you signed says. Is there a way out? If the realtor isn't living up to their end, maybe.

As a builder I rank realtors right up there with used car salesmen.
I'm assuming your agent put your house in the multiple listing service where all the other realtors have access to it. The housing market up here has changed to a buyers market. Two years ago houses would only sit for three weeks, now its three months+.
Did your realtor show you some comps? What are similar houses in your town going for? How long are they sitting? Before canning the realtor see what the market is doing. If other houses like yours are selling for the price your asking it's time to unload your realtor. There should be a termination clause in the contract.

This is from the FAQ at the Texas Real Estate Commission's website..

*3. I listed my property for sale with a broker and the broker has done
nothing about selling the house. Can I break my contract and list with
someone else?*

Your listing contract with the broker was intended to be a legal and
binding contract. If the broker has not fulfilled the broker's part of
the agreement, i. e., advertising, holding open houses, etc., then you
may have grounds to terminate the contract but you would need to contact
a private attorney for help in making that determination. You could also
ask the broker to agree to cancel or release the listing. If the broker
agrees, then the contract can be mutually rescinded.


She hasn't put a flyer box back nor had another open house since Feb..... Granted we really looking for a house at the time, but she was also still representing us to sell this one....

No flyer box in 5 months ?    That's BS - she needs to be straightened out.  You need to make sure she keeps the r box full if she ever puts one up.

If she has a boss or general manager I would put in a call to them to express your concerns, jumping over her.

Most real estate contracts used to be 6 months ?   Maybe you just let it lapse and no legal fight in a month , then find an aggresive realtor...
