Crashed the Charger Today

We were on our weekly cruise and my buddy got rear-ended hard exiting an intersection which pushed him into me and, well, you see the result. They took him to the hospital for observation. His neck & back are pretty sore but no broken bones. His car was hammered pretty bad. Mine is more cosmetic but I will need a new J-Chrome, lol! I looked close under and around the car and I was lucky there was no other damage. That rear part of the quarter panel is going to be a bear to straighten. May have to get a replacement corner if I can find one. The insurance will have to deal with that I guess. More concerned with my buddy, but they said he will be sore, but ok.

I should have known I was pushing my luck cruising this late in the season...

It's a little worse than it looks. Overall, it fared much better than the Hyundai. Unfortunately, the older cars are so strong that the force is transmitted directly to the driver and not soaked up by the car as mentioned. And in this case with the older low back buckets, it means more chance for neck & back pain...

Commiserations.
That is always my biggest worry when I go cruising. To many people on their cell phones (even though it's illegal) or just not concentrating.
The worst is when they come at you over the centre line around corners and you've got nowhere to go. Have experienced some hairy moments!

The Police should be able to check a persons cell phone after a crash like that & see if they were texting at the time of the rear ender, if so THEY SHOULD GET HAMMERED PRETTY HARD ! This inattentive driving has gotton too far out of hand. some people just cannot handle technology with out abusing it :brickwall:

He said after he got hit he tried to steer away from my car but couldn't. He almost made it though! Another few inches and he would have missed. Amazing that he had the time to react and think of that.

   I hate to say it but your buddy needs to sue the person who rear ended him. The driver was at fault and your friend shouldn't have to pay more than his deductible to fix his & your car. Then I would try and get enough to cover the deductible & a reasonable amount for mental anguish. :icon_smile_big:
    In general I don't like the court thing but in this case the person needs to pay. How does some "old car" out brake a new one? I think we know the driver was too close & not paying attention.
    Most of these cases are settled out of court & his insurance company should be able to help. For a personal case he will need to get a lawyer, but that shouldn't be a problem and your buddy is in the right & it would be easy money for the lawyer\shark.

I apologize if I'm sounding nosey.  This kinda stuff intrigues me.

Was you friends brakes applied & he skidded?  These are also prolly ? the insurance will be asking.

A couple years ago we were up in the Seattle area on 405 & traffic came to a screeching halt.  The cars in front of me had a chain reaction crash.  A buddy behind me went around me so I was committed to the lane & shutting down my car.  They said their first thought was, "Uh oh, Mike's gonna crash."

I don't have hand controls (paralyzed) in my hot rods & was able to shut it down.  Very, very lucky that day.

Ugghhh... that is awful to see. So sorry for you & your friend, Bob. Just out for a simple, enjoyable Sunday drive. Damn, people on the road today just suck.

Only if he files with his own insurance carrier. Which, in some cases might be better if Bob is insured with a classic auto insurer.

Maybe not however for the mans injuries, that WOULD prove negligence by a traffic violation and would go against the guilty party so the injured man could get the medical care he needs since they were bad enough for him to go to the hospital PLUS, it would start a paper trail of simular or exact violations and the IDIOT could & should then lose their priveledge to drive. :popcrn:

NY is a "No Fault" insurance state. What that means is your own insurance will pay for your medical expenses regardless who caused the accident. A lot of people think that the term "No Fault" pertains to damage to your car. It does not. The person who is at fault, insurance pays for any property damage. It is just yoru own personal injury expenses that your "No Fault" insurance involves.

That will go nowhere, Pigs. The driver will plead "No Contest" to the charges and be untouchable in a civil suit. Not to give away too many details, but the drunk that plowed my Sunfire at near 100mph is going on with his life. Even with an attorney, my share of the settlement appears to be the meager little-bit-of-nothing offered by the insurance company for injury(before a lawyer was involved), reimbursement for medical expenses, a settlement for half of the car's (real world) replacement value. Any "negotiating" beyond what's listed, the legal firm appears to get to keep. F it all.

I have been lucky so far and never been in an accident, passenger yes but not the driver.

My wife has been sued & the bum got a small settlement. I guess it may not be worth the effort.

Hope he gets feeling better , I know how he feels. I was in 3 accidents in one year.

1st dec 6 2009 a guy tried to rob me and car jack me in my 2000 ws6 vert. I took off hit a pothole(actually more like a crater) blew a tire went over an inbankment into tree and telephone pole.

2nd oct 1 2010 a guy dropped a recliner off the back of his truck on the interstate and we hit it at 65 mph (I was a passenger the other guy stopped and admitted fault but received no ticket his insurance says my friend should of hit the car next to us over the recliner. so now i have a lawsuit)

3rd oct 6 2010 riding with my brother was rear ended  sitting at a light that was green so that we didnt block the intersection (like the law says) a girl texting and driving someone elses car hit us at 45 mph. her excuse I saw the green light not 4 lanes of traffic stopped.

I now have degenerative disc disease, 3 herniated disc, and bone spurs on my vertebrae.

so take it as just being sore.

Hope the cars get repaired and your friend gets better.

I get where you're coming from but seriously it doesn't stop them from driving. We see it on the news all the time. (driving while disqualified. driving an unregistered vehicle. driving without a license etc) they just don't care and show a blatant disregard for the law. The only thing that will keep them off the roads is jail time but the courts are too lenient and mostly they get off with a slap on the wrist even if you're a serial offender. Life's good!

Green is right, & I also hate that it has to be a legal issue, too. Several years ago my wife was driving the Ford pick up we had, & was part of a 4 vehicle accident where a tractor trailer on Rte 84 rear ended a car that was behind her in a construction zone. The car was turned into an accordion, & shoved our truck into a FedEx van in front. My wife was sore, but okay, & our daughter bumped her head on the padded car seat she was in & also okay.

The next day my wife said her neck & back hurt & went to the doctor. The driver's seat was pretty bent so I knew she was going to be hurting. She should have asked for an ambulance & a lawyer instead of going home, but said she felt fine. All we wanted to do was get the doctor visit covered to make sure she was okay & it was a major PITA. After 6 months of BS with the other insurance companies as well as our own, it was done & the truck finally fixed.

The truck driver even admitted on the police report that, "He just didn't see the stopped cars until it was too late."

IMHO the real world isn't that simple.
   
Quite a few people who don't have licenses are in that position because they're broke, not because they are dangerous drivers.  Do we lock them up for continuing to drive to work every day, and punish them the same as a repeat drunk driver or wrecker? 



I'm in favor of keeping dangerous drivers off the road.  But our driving law system punishes people just as harshly for being broke as it does for actually being a danger to others.

It's the same with these blasted speed cameras. You get a speeding fine whether you're  2 or 10 kph over the limit and they're trying to convince us they're only after the dangerous drivers. In my book there's a big difference between accidently going a couple of kph over or deliberately hooning.

It was learned that the company that made the traffic light cameras in Charlotte was making the larger profit on each ticket than the city was. So they quit using the cameras.

I am talking about people who abuse their priveldge to drive, those who are reckless & reak havoc wherever they go, irresponsible is the word i am looking for, they want a nice car but refuse to shell out the money required to insure it. Instead of paying insurance they use the money to party or whatever, and then go out start text messenging while driving and HURT PEOPLE WHO THEN HAVE TO SPEND THEIR MONEY TO SUPPORT THE IRRESPONSIBLE DRIVER Those bad drivers need to have very serious consenquences for repeated acts of irresponsibility and need to be held accountable for their actions. THEYARE NOT  BEING PUNISHED FOR BEING POOR :rotz: MAYBE THEIR BAD driving habits caused their insurance rates to go sky high, i have seen that happen to bad drivers that i knew. when they don't have insurance they should NOT drive because they go out & continue their BAD driving habits and text message while driving on top of that. The facts are right when they say people who constantly text message while driving are  just as dangerous or even more than drunk drivers. there are MORE texters while driving than there are drunk drivers on the road. I am getting FED UP with having to take evasive action because some idiot ran a stop sign entering a highway because they are not looking UP at teaffic right in front of them. a few months ago a school teacher was leaving school in the afternoon, started texting leaving the parking lot, was 15 MPH over the speed limit IN the school zone and never looked up until she heard her windshiled smashing from the 2 kids AND THE CROSSING GUARD she just ran over IN THE SCHOOL CROSSWALK WITH ONE 7 YEAR OLD SMASHING UP OVER HER HOOD INTO HER WINDSHIELD AND THE THUMP THUMP THUMP THUMP OF THE OTHER KID  & elderly crossing guard  going  UNDER HER TIRES KILLING  THE CHILD. & permanately crippling the crossing guard :flame: :brickwall: THE KID WHO WENT INTO the windshield is still recovering while the crossing guard at age 67 had her hips busted to pieces among other internal organ injuries. this was the third citation for using a cell phone while driving & having an accident while using a cell phone was 2 of those citations. That teacher is devastated she says about killing the child and hurting the other 2 people as the dead child was her straight A student, the child that went into her windshield was the dead childs sister. That teacher had her license suspended for 60 days and guess what ? 3 WEEKS AFTER THIS HAPPENED driving on a suspended license,, THAT TEACHER WAS CITED ONCE AGAIN FOR DRIVING WHILE TEXTING CAUSING A HIGHWAY PATROL OFFICER TO TAKE EVASIVE ACTION TO AVOID HER VEHICLE WHEN SHE RAN A RED LIGHT IN AN INTERSECTION. DO YOU THINK SHE EVEN learned her lesson ???? i say no she didn't and she should have her driving priveldge revoked permanately. SHE IS A DANGER TO EVERYONE ON THE ROAD OR EVEN IN THEIR HOUSES AS SHE MAY PLOW RIGHT INTO SOMEONES LIVING ROOM. rant over !
