Ok, so after a question about it I went ahead and set up a page for us on Facebook:

I'm not really sure what I'm supposed to do with it but I may use it for announcements. I know it will be handy for finding other members and learning a bit more about each other (although not everyone who "likes" the page or posts on it will be members of the forum). It should help spread the word about the site and help us to grow at an even faster rate (or it could flood us with spammers and kids who post a lot with nothing to say).

Banks 'friend' people on Facebook, then foreclose on them

Facebook isn't just for your "friends" anymore, as unlucky home-owners facing foreclosure are finding out.

After failing to reach an Australian couple who defaulted on their mortgage by mail or phone, the bank's lawyer served foreclosure documents via Facebook after verifying their identity by matching names and birth dates and "friending" them on the social media Web site.

"It's horrible," said Melanie Griffiths, a Hub tenant activist at CityLife/Vida Urbana. "Using social media is a perfect example of how banks see homeowners as profits, not as members of the community who have a right to privacy."

The Facebook foreclosure phenomenon started in 2008 when an Australian judge approved a lender's effort to foreclose on a home by serving notice on the borrowers' Facebook account, as well as at their Canberra home and a second address.

The couple were considered successfully notified in the eyes of the court because within a day of receiving the notice, they tightened their privacy settings. Shortly thereafter, MKM Capital, the lender, seized and sold the house.

Since then, courts around the world have approved the use of Facebook in similar cases.

Earlier this year, a lawyer in East Sussex, England, persuaded a British court to allow a lender to serve foreclosure papers to a woman through her Facebook account, after demonstrating that calls, faxes and visits had failed.

Marc Rotenberg, executive director of the Washington, D.C.-based Electronic Privacy Information Center, said he hasn't heard of any U.S. cases of foreclosure by Facebook so far, but he expects the tactic to jump the pond soon — and he has no reservations about it.

"This is less about privacy and more about due process," Rotenberg said.

"If you're about to be subject to legal action, then it's important to get notice, whether by a service processor or online."

But Lewis Finfer, executive director of the Massachusetts Communities Action Network, said serving a foreclosure notice on Facebook is just wrong — and raises a host of concerns.

"My computer was hacked into and had false messages sent to my friends saying I was in trouble in Europe and they should send me money," Finfer said.

"There are those kind of manipulations that are going on with access to people online and it's troubling."

Barbara Anthony, undersecretary of the Massachusetts Office of Consumer Affairs and Business Regulation, said she sees no reason why Bay State lenders would need to use Facebook to serve foreclosure notices.

"I've never heard of one instance where a Massachusetts lender has been unable to provide notice to homeowners," Anthony said.
