ChrisII.. you seem to have the correct concept on this whole thing. Yes in Wisconsin, originall title takes legal precedent over a duplicate. The car is in the state but our DMV will not devulge further info.

Sounds to me like the original owner tried, and possibly succeeded in selling the same car twice. He probably lost the title and got a duplicate, Sold the car and then found the original title. If that is the case and the original owner signed off the duplicate title, I would think that the original title is no longer valid and the original owner is guilty of fraud.... And if that's the case then what dkn1997 posted back then might still be true:

what just happened to you is usually accompanied by a large jar of vaseline, an expensive dinner, or a at least a nice piece of jewelry....

Bet you don't get a kiss or a reach around either.

Well I found it today. Got a good look at the vin. She's rougher than my GTX maybe as bad as my 68 Charger (which is REALLYBAD). But I must say the guy had a bit of a collection. A 66 or 67 a 68 the long lost 69 a 72 ish Chally and a 69 RR. Although all the cars were plated you could tell they havent been moved in years. This guys not out by himself, he's a a neighborhood of small homes/lots... I'm surprised none of the nieghbors put up a fuss (maybe thats why there all plated). I dont need another rough project thats for sure but the thrill of the hunt was fun. I just wished somebody was home... but thats for another day.
Heres a cell phone pic....

i read both threads and im still a little confused. so do you plan on trying to take the car from the guy who currently owns it, as in the car has been sold twice with two different titles? or did you find it where the guy that sold it to you 5 years ago left it?

adauto

This whole thing was confusion from the start! The extremely abriged version is - dont try and deal with srewy people!!
Car was for sale-
Had paperwork-
Car in nearby town-
things took forever=
gave a very modest downpayment to attemp to expedite the process-
this is after the title is signed over to me along with a bill of sale-
starting to wonder if the individual isnt on some kind of physc drug-
could not get car to materialize...but individual wanted agreed on money-
screw you show me the car-
found out car did exist and was registered in my state-
really pissed me off-
i'm the type "it aint over till I say its over"-
in my state origial title takes precedent over duplicate-I have original-
always kept an "eye out" over the years-
time passed took on other projects-
by this time it was more of a curiosity-
mellowed just a bit in my advanced years-
got a name and address-
took a look-
parts car IMO-
got a few of those already-
would still take on the cheap but really no longer have the desire-
i spent more on gas in NIKKI this past weekend than what I put down-
but took a nice ride on a nice day with the top down and got a ton of thumbs up

the end

yes and I know I could petition the state because I hold original title. But its just not worth it now IMO.

How much money did you actually give the guy, it sounds like he signed over the title on just a deposit?

Wouldn't you basically be stealing the car from the guy who has it now? Even though the other guy ripped you off. Or am I misunderstanding?

Yes, but apparently not any more than he's already been ripped off. If I understand this story correctly.

So why not petition the state and then if the decision comes down in your favor see if you can settle for the amount of cash you lost instead of taking the car? I have to assume the guy would be more willing to cough up a couple grand (just guessing :shruggy:) than hand over the car. I would think also that someone should eventually go after the guy that screwed you over.

there's been other stories on here about stolen cars returned after 20+ years. if you buy a stolen car or one with crook title, you simply loose out whatever you paid for it. Looks like this one is a piece of crap and not worth pursuing.

moparsons

Just saying....(if I'm understanding right) :scratchchin:  The guy that has it now apparently bought it with what he thought was a legal title (which it would be until the original title resurfaced). So to me......it would be wrong to try and take the car from him.  Just go after the guy that sold only the piece of paper (original title) without the car  to ya.
This car wasn't stolen from the poster. He never took possession of it. He only bought the title for a "down payment" on it.

To go after the original seller would be like this ... nothin ' from nuthin' makes nuthin'!! Been down that road before, I dont know what you guys value your time at but........ no...

If you read this entire post you can see I spent more on gas that weekend than what I had down ($100) Judging from all the cars parked there this guy looked like a "I'm gonna restore it one day " type. To be honest it looked like his house was in about the same condition as the cars parked there.

So you received a title for a '69 Charger that's suppose to have Hemi with a "very modest downpayment" of $100.--

The wind must be coming up from the south cause it sure is stinky outside.

I agree, Something smells mighty... Odd to say the least. The car looks like it's sitting pretty level for there to be "nothing in it", plus if someone intentionally stole money from me there would be repercussions, especially when they tried making a fool out of me.
