Its sad when people think a government employee has rights to be on your property.  They have zero rights when it comes to personal property.  The owner of the property has all the rights.  But that Cop just acted like the owner of the propery was a nut.  Unreal.

The 4th amendment was created to stop this from happening and yet because no one knows what their rights are as property owners they let this happen.   If this stuff keeps up, it will be a matter of time till someone stands up for their rights. 

She should have been forced to the ground and that cop forced to leave.  No warrent no access, no exceptions I dont care what some judge has said in the past.  The 4th Amendment is the Law end of story.

Because there is no better country.  America is the best nation in the world.  Land of the "free".  Does free mean anything to anyone anymore?

Why do we have one in the frist place.  Do you know why?  I can give you a hint. its to prevent what you see in that video from taking place.

I am ex US Army.  I have no plans on leaving the nation that I took an oath to protect. 

When you take an oath to protect the US Constitution, you dont get to toss out of the Constitutionwhat you dont like.  We were given a Constitution and must protect it.

we the people are our own worst enemies.....we let the govt get away with this time and time again....we elect politial hacks to office who abuse the power they are given by us, the people, to use against us in any way they see fit. we give badges and guns to uneducated bubbas who have no concept of the laws in which they were hired to enforce, or the constitution in which they swore to defend against all enemies,both foreign and domestic.
I expected the behavior of the local bureaucrat , acting as if she knows it all, looking down her nose at a man trying to defend his rights, but the behavior of the deputy was deplorable.


And yes, I know that all Law enforcement officers are not like that......but many are. and that is just wrong.

I am sure he sued them. He could have whipped her ass and got away with it. He should have called
HIS own officer. I would have at least snatched the camera. Anyone can forcefully remove a tresspasser. It is a no brainer no mater how smart the cop thinks he was.

I deal with wackos like that all the time in my job.  Of course the woman has a right to be there, that is first year law school "administrative search" stuff (ask the esq. guy who posts here).  The sheriff should have arrested the nutbag for interfering with a public officer.  Years ago, my best friend in Reno became a health inspector.  His first job was going out to skummy Sun Valley, a huge trailer park right by Reno, after a dog bite to quarantine the pit bulls. He would get the same kind of slack jawed "Constitutional" arguments, would call the sheriff, and would take the dog.  Over and over and over again.  C'mon, they are doing an admin search, not a criminal search.  No 4th amendment issue there.  Kim

I am no expert. But from what I was taught, the Constitution was written to basically protect the people from the Govt, not the other way around. In my opinion, Judges and lawyers who, over the years have interpreted the Constitution as a "living, breathing document" have done more damage to this Republic than any Foreign Enemy.

Bingo.

Most people do not know what rights are or who has them.  No Government employee has a right to do anything over a citizen of America.  That is day one history stuff you learn in the 3rd grade.

Bill of rights were established to ensure Government would not step on the peoples rights.  But along the way that water turned to mud and now people think our rights are given to us by Govenment and not our Creator.   

If government employees had rights like you see this woman in the video say she has, then why did our founding fathers even bother to make sure we were given a Bill of Rights?  Why waste the ink?

Rights of government exists only in a Communist form of government where government is the only owner of propery, not in a republic where the people have the rights and government serves the people.

Sounds like a lot of people like to hide behind these amendments I keep reading about in this political section of the site.

Here is an idea, if you don't do anything wrong you won't have to worry about this constitution or its amendments that were written back when the currency of choice was beaver pelts.

I agree this lady was out of line here but let me ask this, what if you believe your neighbor whom happens to live uphill from you has a major health code violation such as an illegal septic system he just decided to throw in 1 day in his yard or dumping used motor oil near a stream that happens to run downhill through your property. Is there nothing you can do about it because he wont let anyone into his yard to investigate?
