Well I just got off the insurance company concerning that accident awhile back in my friends Ford Focus. We finally agreed upon a settlement price, $3600 CDN... Im going to take 1/3 of that and put it away, and 1/3 will be going into the Aspen for new tires and front end work. Not sure what the other 1/3 will go into but we'll see.

Did you ever get the hesitation issue resolved on the Aspen?

Did you have a Lawyer representing on your behalf ? or did you just deal with the insurance company one on one. Because they will low ball you and they do not want to see lawyers involved.

The only time a lawyer is needed is if I was suing the driver. A friend works for ICBC and told me that $3600 is one of the largest payouts shes heard of for a passenger who wasn't injured.

Got it fixed just before one of my front tires got ruined by my uncle. I got to light the tires up at least once and it was a good one!

man i'm glad people aren't like that around here.. it's unheard of for a passenger to get a settlement check when uninjured..that's sick. insurance prices would be even more astronomical here if that was the case

I was injured but what I meant to say was not long term as in broken bones, stitches, etc.

Steve P.

This is a very tough one.  My daughter was injured in a school bus accident in her 10th year. The bus was hit from behind. (ANOTHER CELL PHONE WITH MORE IMPORTANCE THAN A BUS FULL OF KIDS). Anyway, she and many others ended up hurt. No blood but much whip lash. She had to go for plenty of therapy on her back and neck. Headaches all the time. After another year or so she was coming around. Headaches all but gone. Back feeling much better. Then the insurance company calls wanting her to go for a final MRI and evaluation. All looks good. Next comes the offers of settlement.  Not being the types that are on the phone with a lawyer we discussed it among our family and in the end took it with a few extra bucks for all of the time and gas we used taking her to all these doctors and therapists. It was not a very large sum of money and for those who don't know, once you settle it is all OVER. PERIOD.    Now at 22 years old she is having back issues. She just had another MRI and her back is a mess.

My point:  Though you may feel, (as I did), that a lawyer will push the price up and then insurance costs go up for all, (and they do), get a lawyer. Not one that wants to settle fast. Not one that EVER SAYS to do this or that to get more. Find a BOARD CERTIFIED lawyer with a good track record and still use your very best judgment. They know the tricks the insurance companies play and know how to use it against them. We tried to get the MRI from the wreck and it is not available to us as the case has been settled. We did have a copy from back then and were stupid and cannot find it now. It would not make any difference as it has been settled, but we would at least know if that caused todays pain.
