Need some advice.(updated, hes responds.....finally)

Im in kinda a bind.  I sold a running 318/904 combo back in the first week of July and the buyer was supposed to come pick it up on the 18th, waited around and never showed. called that evening said he had to close on a house.  Ok thats cool, says hed pick it up in two weeks(from that day).  Then he called, cant make it says he'll pick it up no later than the 25th of august, well, he never showed again. Said hed pick it  up on Labor day weekend.  Never shoed then either.  So the next time i talked to him, I told him that Id be willing to store it till the end of september, and then id need it out of my way so we can tear into our combine and rebuild its motor.  Well now its november and ive been trying to get in touch with him seeing that i have heard nothing from him since August.  Ive even offered to make the 3 hr trip and deliever it to his door (for free) and no response and thats been three weeks.  I understand that stuff happens and stuff comes up(dont believe me ask fellow member max whos been holding a motor for me for a while, but ive stayed in contact with max)  The buyer is not a member here and has already paid me for the motor back in July.  I dont know if i should keep waiting on him to pick it upor put the motor back up for sale being that hes not showed up the three times ive taken off work to meet him at my house  This has cost me hours and pay from work( three 8hr days without pay equals to damn near 350 dollars, well more than the 125 he paid for the motor) and he doesnt bother to call saying that he cant make it, just doesnt show and then calls a few days later.  What should I do???  If i do end up selling it, do I refund his money if he ever does contact me??

Sell it to someone else.  If he ever shows up and somehow has a legit reason to ignore you for months, just hand him his money back.  Otherwise, I'd say keep the money for the trouble hes caused you and the pay hes cost you.

by the sound of it he ain't going to come for either the money for the motor! I would sell it or put it outside with a tarp! It is obvious that he isn't going to talk to you after 3 weeks and it sounds like you have bent over backwards to help him out! Send one last Email saying I will deliver it and if I dont hear from you with two weeks I will be forced to sell it to someone else!

Yea.....sell the engine to someone else and when he does phone....tell him to COME GET his money and when he comes to get it, hand it to him and tell him to F*** off :D

yeah i just hate to do that to someone.  I mean theres members on here that have been very patient waiting for me to come get stuff.  THe only difference is that I try to keep in constant contact with the seller.  I know the guy had some issues legally with the house he was tring to buy, but a simple email or phone call would be nice.  I can continue to store it but i  need room for that dang ole combine.  I could store it with nachos quarter panel, but id rather not have to move it to the back barn, itd be a pain in the ass to move that hoist on gravel. i dont wanna just throw it outside to let the indiana weather destroy it either.  Its a nice motor and trans, car was rottted away bought it ran and no smoke, might need a new timing chain as its stretched a little overtime.  I might just give him until thanksgiving and then ill sell it and tell him that i dont give refunds for storing the thing for 4 almost 5 months.

Thats what I would do. Like you said, crap happens sometimes, but tripping over the thing stinks to.

Maybe just put the 318 in the combine? lol, jk

318s are tough but not near as tough as a 250 horse, 600 lbs diesel  It wouldnt be able to turn the 7ft tall wheels

I'm not a lawyer, but I have seen quite a bit or those TV court shows. There was a case just the other day exactly like this. Person A bought something from person B. Person A called person B repeatedly for a few months to pick up the stuff. Finally person A dumped the stuff. Person B sued, but lost. The judge said he "abandoned" it by leaving it for so long.

Keep the money for your trouble and resell it.


I sold an old Chevy to a guy in Cali. After it sat there for 6 months I resold it. I never even heard from the original buyer.

If he paid you for it...it sounds like he has no where to put it or scared someone will see it(wifey). Send him a letter, just cut and paste what you wrote above and at the bottom tell him he has two weeks to pick it up or it will be sold and your keeping his $.

If he tries to pick it up make it when your available and don't have to take off work.

sent him an email and told him that he had till thanksgiving to pick it up or i was selling it and there wont be any refunds regardless.  That was sent yesterday with a read recipt requested and he read it but no response.   :brickwall:So who knows???  :shruggy:I dont think hes gonna get it so if anyone is needing a good solid 318/904, let me know, ill cut you a deal if you pick it up asap.

sounds like hes not interested in the motor or the money , if he has just done a deal with the house then the money in the motor is small change . Good on you for your integrity in keeping contact with him (so long as people keep in contact that makes the difference , at least that way you know whats happening ) .
Unfortunately the world is full of " muppets " who waste peoples time energy and money so i say keep his money sell the motor etc to someone else who will appreciate it more  youve done more than most would   :2thumbs:

i try to be understanding and flexible with people since others have been fl;exible with me.  i mean the person im buying my motor off of and i have been working this for months but it was always understood that if someone could get it sooner, than by all means sell it. and i stayed in contact with him.  it just erks me that he wont respond to phone calls or emails and when he does he acts like its my fault. rant over

That's the way to go.
This car was sold many years ago to somebody in Wisconsin. I now am retired and living in Florida.

If he's already paid for it, then it's really his engine now.  Charge him storage for it since it's in your garage.

If he hasn't paid for it, it's still yours to do whatever you want with.   I'd sell it to someone else.

i think what im going to do in the mean time, cause i need room and i hate to do it, but im going to just put it outside under a tarp and thats where itll stay till he comes gets it.  Yeah, hes paid for it, but that was under the conditions that he had 30 days to come get, not 6 months.   :flame:

That works too.  If he complains about it, then just tell him that he was supposed to have picked it up weeks ago, that you went out of your way to help him out, and that you finally just had to get the thing out of your garage.   It was either that or start charging him storage.

You don't owe the guy anything. You have done your part and then some to accommodate him. He has abandoned the engine. You should feel free to sell it and to keep what is now YOUR MONEY!

update, no contact or anything from seller, read recipts show hes getting them, so who knows,  i know this will probably piss him off if when or if he sees this, but oh well, motor is back up for sale, no refunds to him.  im just plain out sick and tired of now communication for months now, when i can see that he is logging into the abody site daily and ive sent him pms through that as well :flame: Check out the parts for sale section. pictures included

The smallest storage lockers around here are $25.00 per month. How long have you kept it out of the weather? How long have you been tripping over it?? How many days from work? How many OTHER things could you have worked on??
