Ever buy parts from this seller on E-Bay? Ripped off, Pistol Grip Shifter

Here is the deal, I could be wrong on this, correct me if I am,
   I see this Slap-Stik Pistol Grip on E-Bay. Bid on it, I have been wanting one of these for a long time, good deal, over 50% less than what one is new.
I E-mail seller several times asking about what year Charger it came from, etc.
He says that he thinks it is from a 71' Charger but not sure, not sure where it came from even.
I said is it broke and does it function.Seller says yes. The auction states all sales final, I ask seller if it does not fit my Charger will you re-fund my $.Seller says yes.   I receive the shifter and it does not fit all the way down flush with the shifter mechanism,looks as if a small piece is broke on the bottom, right under the set screw.
I e-mail seller, he says go f-yourself. All sales final.
I file a complaint with Pay Pal.
I feel ripped off. Does it look like a piece is broke or am I installing it wrong?
The crook's user ID is triplethunder99,    he or she is from PA.
The seller did not even bother to try and help me in any way. I have allmost 800 transactions on E-Bay and this TURD with 9 is telling me how it is.

can't really tell from the pictures but it looks ok to me. it doesnt slide all the way down the shifter mech there is a rubber grommet? (a short piece of rubber hose) that slides down before you put the handle on and keeps everything snug.
