I think it sucks things did not work out for you but I think Dodgechargerneeded summed it up best with " first come first serve".

The best thing to do is trust your "inner feeling" when you talk to someone about a car purchase.  If you feel the least bit queasy about the person, its usually a good idea to go elsewhere to find the car.  On the other hand, if someone is painting a overly rosy picture and the car you see doesn't match up with it, be real careful.  Its easy to get taken in and get a deal that isn't quite what you dreamed it would be.  These days its much different when buying old mopars, the cars aren't usually 40k to 60k originals in pretty good condition.

I'll bet everyone single one of the guys on this forum has the same or a similar story, happened to me when I was 4 hrs. into a 5 hr. drive to purchase a 69 charger, someone just beat me there with cash in hand, boy was I pissed but like most of the guys will agree - cash is king baby! if you want a car bad enough you'll do whatever it takes to verify whats important to you and get it - period.
I do beleive however that everything happens for a reason - trust me - you'll look back at this when you find that dream car and think - boy am I glad I didnt get that last one or I never would have been able to get this one!!

Good lucj and happy hunting

I do have to wonder about how "correct" the car was when the seller took so long to get you any information.

That being said, I also agree with the others in that if you didn't have a deposit down, the seller had no obligation to you and didn't sell the car out from under you.  You had no claim to it.

A few years ago I sold my 70 V-code Charger.  The first guy who contacted me sent me a $100 deposit.  I had several people call about it afterwards, one even offered me more than I was asking, and I had to put them on hold until the guy with the deposit made his decision.  He finally bought the car.  Had I sold it to anyone else, I would have "sold it out from underneath him."

I hope to pick up another second gen in the coming years, and I'm sure I'll end up going through some of the same issues.  Don't look forward to it, but, it's the nature of the buying beast.
