Thanks! However, that sentence was probably so light due to all the character witnesses and his career as a poiltician so I can't see bad boy biker Billy Lane pulling that off. I also don't know the sentencing guidelines in either state or how the outcome will be affected if they can prove that alcohol was involved.

Either way, he has to live with the knowledge of what he's done for the rest of his life. I am positive that he did not wake up that morning with any idea of how that day could/would end. The seemingly irrelevant choices we make every day can have much greater impact on others than we can imagine. Had a tire blown out and sent him across the line - even due to his own negligence - I'm sure the mood of this thread would be completely different.

Blood alchohol tests are mandatory in serious injury or fatality accidents even if you appear to be stone sober.  At least it's that way in Missouri.  You can refuse if you are concious but if you are unconcious or deceased your consent is implied and the blood is collected.  I would imagine it is that way in most states.  I'm sure the moped drivers blood is on it's way to the lab as well.  Also, a blood test is much more accurate than a breathalyzer.  A breath test will read lower than your actual BAC whereas a blood test is right on the money.

As far as jumping to conclusions it seems pretty obvious that he passed in a double yellow and killed somebody.  I wasn't there but that seems to be supported by the statements given by Police.  Generally when somebody is acting with negligence and kills another human being there are criminal charges.  I would say that passing in a double yellow is negligent since it is illegal.  I don't know about the error chain but we refer to the "accident chain of events".  And yes many things contribute to the accident chain with each little factor making up links in the chain.  However, there are illegal factors and legal factors.  As far as I can tell this poor guy was putting along on his moped, in his lane and gets mowed down by a truck passing in a no passing zone.  Dusk and dim headlights aside the guy had every right not to expect somebody to be driving right at him in his lane.

On a side note we don't know if Lane was drinking or not and I'm not rying to say that he was.  However, I am a big fan of the discovery channel and I can't count the number of times I saw him drinking a Corona on camera.  Put that together with the fact that he has a DWI case pending right now and well... you see where I am headed.  I hope for his sake he wasn't drinking.  Just my  :Twocents:

I spoke with the prosecutor in my case just today, the gal that hit me has 5 previous convictions for driving with licence suspended and also negligent driving. She failed the breathalyzer but they are awaiting the outcome of her blood test, a couple more weeks for that. The prosecutor envisions charges of DUI, Hit and Run Injury, and possibly Vehicular Assault. He is pretty sure she is looking at "years in prison". Then court ordered restitution (yeah right).

Motorcycle repairs - $6100
Medical bills - $50,000+
Ambulance ride - $600

Pain and Suffering - Priceless

Check if your insurance covers you for uninsured motorist, sometimes you can get $20,000 or whatever your policy limit is at. I have mine at $50,000 for that reason. Still not going to help you much, but look in to it-each state is different.

Does that bitch own a house or anything else ? Good Luck hope you get something to cover your bills and hope you start feeling better soon.

If she has that many previous convictions for DWS it should be felony on this charge.  I don't know what state your in but an injury H&R in Missouri is a felony too.

Sorry to hear about that Bob.  Good thing you will make a full recovery.   I bet nothing happens to the chick that hit you. She may get some more charges on her and some  probation.  No big deal. She dont have anything so you will have to cut your loss's and hope your insurances will cover your costs. Sounds like you been screwed by the game of life.

$15,000 bond--he be out in a few hours. He going to spend way more then that on a lawyer or lawyers. If that amount of alcohol is right .19 thats about as drunk as you can get without passing out. No this " I did not know I was drunk" BS. In some states it be a murder charge-hes luckily.

I have no clue what will happen with Billy. I really don't care who he is or what he does. I would say this, if there IS any good to come out of this, it would be that many people have heard/read about it and it will wake someone up..


Florida has some shitty laws when it comes to accidents. I have 2 totally ridiculous stories about it and one of them is with my daughters recent wreck. I'm too tired to type it all out now. Just trust me, if you could get away with insurance/law anywhere, it's here..... :flame:

All I know is Florida has some screwed up laws. Take drugs-if the police find one joint in a $100,000 Limo that is begin rented out by the party who  joint it belongs too the cops can take the Limo for good ! Even though the owner of the Limo had nothing to do with it. Thats unfair. But on the other hand some hippie can be driving super drunk on the wrong side of the road and kills another motorist, he gets a $15,000 bond. I am not even going to get in to its ok to shoot some body in the back law but thats screwed up also. Sure would be nice to have a big boat on the ocean there but sometimes happy I am in Michigan.
