Well Progressive came out and gave an estimate on the truck. It came back at $825. $400 for a bumper assembly and $400 to pull the frame. I took it to the shop who did my Nova and he said it is a fair amount and he'd do the work for that. I feel better about that part.

Now the bad. I called the Dodge dealer I was dealing with on possibly buying a new truck. 2 weeks ago they offered $14000 trade in on the truck. Now they will only give $12000 after it is repaired. This is explained as depreciation especially since Carfax will flag the truck as having previous frame damage. I understand where they are coming from with this. I called Progressive back and explained that since the accident my truck is now devalued $2000. The agent disagreed and started citing things that will take too long to type here. I told her my attorney disagrees with Progressives stand on denying this claim. I told them if needed we will file suit against the vehicle owner and driver. Progressive will then be liable for providing them an attorney. If I won they would also owe my attorney fees plus settlement. The adjuster passed me to a manager which is who I am dealing with now.

The manager calls and says Nebraska law does not require Progressive to reimburse for depreaction and stated depreciation will not exist if the vehicle is repaired correctly. I disagreed citing any history search will show the accident and frame damage. He told me the dealer can't lower their offer on trade in, it's against the law. Whatever. I called Dodge and the Sales Manager called the Progressive manager and explained his case and stood his ground on the lower offer. Progressive never called me back after that.

I'm not trying to abuse the system but I think everyone here will agree that with frame damage the truck is worth less even if it is fixed. Heck, the GMC dealer said no more than $10000 trade in because they would not sell a truck that had that type of damage and they would wholesale it immediately.

Once again, I AM NOT trying to abuse the system but I definately want what is owed to me. Opinions??

If its only $400 to fix the frame it can't be that bad-theres frame damage and then theres bad frame damage. I think the dealer should not be knocking $2000 off the trade. But you went to another dealer and they told you the same thing.

How about if you find another Dodge dealer and have them-the dealership fix it-maybe if they know it was repaired right they would give you a better price-it might cost more but thats the insurance problem, you should be able to get your truck repaired where you like-with in reason.

If you do know a attorney first talk to him or her each state is different so they would know the law.

Hows your wife feeling ? Maybe -depending on your state again-her damages are worth something. I know here in Michigan you almost have to be hurt very bad now but it was not that way a few years ago. You are not doing anything wrong for trying to get some $ for pain and all shes been though. This is the BS the insurance company's try to say to get people to think its wrong or not right to receive money when you get hurt. You and her did nothing wrong and should be compasted for the injury's. Again talk to a attorney, you had a accident and your truck frame is bent so you got hit harder than you thought. You are not doing anything wrong by having a attorney help you out.

i totally understand your point of view.. i'm just "taken" losses like that, and never pursued legal action, but you are right. dealers just will not give you the same amount once it's been wrecked and it shows, whether it is salvaged or still clear (title).. the dealership is not lying to you. typcally once a vehicle coming in on trade is a certain amount of years old(usuaully 5).. or it has been in a major accident.. they usually do just wholesale the vehicle. which obviously nets them less. as it was. they were going to give you $14k trade, and sit it on the lot for 15999 or something.. now they are not. let us know how it works out

This is why I won't purchase any vehicle newer vehicle. Because of crap like this.

I just live with a nice 98 truck that if it gets hit or damaged. No biggie. I just keep on driving it.
