Any Car Insurance Agents? - Question.

I live in a tort state (not no-fault). Uninsured Driver coverage is not mandatory in the state – only Liability. My question is: If I purchase Uninsured Driver coverage and an uninsured driver hits me, am I forced to use the Uninsured Driver portion of my policy and pay the deductible, or can I tell the other driver that I am electing NOT to use my policy and ask them to pay for the damages (to avoid the deductible payment)?

If nobody chimes in, one of the moderators on Moparts ( not_a_charger ) works for an insurance company. Not sure if you even go on that site?   :shruggy:

I can't answer the question but, I doubt that someone driving around with no insurance would even have the funds for the repairs.....
